Randy Kamp, MP applauds Prime Minister Stephen Harper’s announcement of a judicial inquiry into the decline of sockeye salmon in the Fraser river

VANCOUVER – The Honourable Stockwell Day, Minister of International Trade and Regional Minister for British Columbia, on behalf of Prime Minister Stephen Harper, today announced the appointment of The Honourable Bruce Cohen, Justice of the Supreme Court of British Columbia, as a Commissioner to conduct an inquiry into the decline of sockeye salmon in the Fraser River. Randy Kamp, Member of Parliament for Pitt Meadows-Maple Ridge-Mission and Parliamentary Secretary to the Minister of Fisheries and Oceans applauds the leadership of the Prime Minister in striking the inquiry. “Our Government determined that the best option to address this crisis was to establish a public inquiry that is robust, independent and takes into account all potential causes for the decline of the Fraser River sockeye salmon population,” said Kamp. “It is in the public interest to investigate this matter and improve the longer-term prospects for sockeye salmon stocks.” As Commissioner of the Inquiry, Justice Cohen’s mandate will be to investigate and report on the reasons for the decline of sockeye salmon in the Fraser River. He will make recommendations for improving the sustainability of the sockeye salmon fishery in the Fraser River, including, as required, any changes to the policies, practices and procedures of the Department of Fisheries and Oceans in relation to the management of the Fraser River sockeye salmon fishery. The report resulting from the Inquiry will be submitted to the Government on or before May 1, 2011. “This is a significant and important issue for all British Columbians who share an interest in this iconic species,” said Kamp. “Our Government is deeply concerned about the low returns of sockeye salmon to the Fraser River and the implications for the fishery.” Justice Cohen has been appointed as Commissioner under Part 1 of the Inquiries Act, with all the powers set out in the Act, including the authority to hold hearings, summon witnesses and gather evidence needed to conduct the inquiry. Terms of reference and biographical notes are attached. Justice Cohen will be unavailable for public comment until the Office of the Commissioner is established. Backgrounder Terms of Reference for the Commission of Inquiry into Decline of Sockeye Salmon in the Fraser River Whereas the decline in sockeye salmon stocks in the Fraser River in British Columbia has necessitated the closure of the fishery for a third consecutive year, despite favourable pre-season estimates of the number of sockeye salmon expected to return to the Fraser River; Whereas that decline has been attributed to the interplay of a wide range of factors, including environmental changes along the Fraser River, marine environmental conditions and fisheries management; Whereas the Government of Canada wishes to take all feasible steps to identify the reasons for the decline and the long term prospects for Fraser River sockeye salmon stocks and to determine whether changes need to be made to fisheries management policies, practices and procedures – including establishing a commission of inquiry to investigate the matter; And whereas the Government of Canada has committed to full cooperation with an inquiry; Therefore, Her Excellency the Governor General in Council, on the recommendation of the Prime Minister, hereby (a) directs that a Commission do issue under Part I of the Inquiries Act and under the Great Seal of Canada appointing the Honourable Bruce Cohen as Commissioner to conduct an inquiry into the decline of sockeye salmon in the Fraser River (the “Inquiry”), which Commission shall(i) direct the Commissioner Backgrounder Honourable Bruce Cohen Justice of the Supreme Court of British Columbia Mr. Justice Cohen was born in Vancouver. He received his B.A. (1962) and LL.B. (1965) from the University of British Columbia and his LL.M. (1966) from the University of California (Berkeley). He was called and admitted to the Bar of British Columbia as Barrister and Solicitor in July 1967, and upon his call he joined the law firm of Ladner Downs (now Borden Ladner Gervais). He was elected a Bencher of the Law Society of British Columbia in 1978 and served as its Treasurer (President) in 1986. He was appointed a Queen’s Counsel in 1983 and retired from practice to accept his appointment on March 25, 1987, to the Supreme Court of British Columbia. He is Past President of the Canadian Judges Conference (now the Canadian Superior Courts Judges Association), past President of the Canadian Institute for the Administration of Justice, and member of the Advisory Group to the Chairperson of the Canadian Judicial Council. |
